Terms of Service

1. General

These Terms of Service (the “Terms”) set out the conditions for using the HiMentor mobile app (the “App”) and the himentor.org website (the “Site”), operated by HiMentor Ltd, a company incorporated in the Republic of Cyprus (registration number [HE number], registered office: [registered office address], Cyprus) (“we”, “the Company”).

By installing, launching or using the App you accept these Terms and enter into a contract with us on the conditions set out here. If you disagree with anything in them, please do not use the App.

The Terms apply from the moment you start using the App and remain in force until you stop using it and delete your account, or until access is terminated as described in section 12.

Any updates or changes are published in these Terms. The procedure for changing them is described in section 15.

2. Definitions

  • App — the HiMentor mobile app for iOS, including all its updates and components
  • Site — the himentor.org web resource, including its checkout and legal document pages
  • User — the individual using the App
  • Account — the User’s record in the service, identified by an email address
  • Subscription — paid access to the App’s extended features on an auto-renewing basis
  • User Content — the data a User enters: food log entries, messages to the AI assistant, settings, support requests

3. What the App does

HiMentor is an informational and educational tool for tracking nutrition. It lets you:

  • track calories, macronutrients and micronutrients;
  • keep a food diary and export it to share with a specialist yourself;
  • follow your weight over time using storage on your device;
  • receive reminders about supplements you have configured locally;
  • receive informational suggestions for correcting nutrient imbalances;
  • ask the AI assistant questions about nutrition and receive informational answers.

The food diary export is intended for your personal use. It is your decision whether to give it to a doctor or another specialist — at an appointment, during an online consultation, or simply to check your own results. The App does not send data directly to any medical institution or practitioner. The export is not a medical document.

The set of features may change. We may add, modify or remove individual capabilities; how we notify you of material changes is described in section 15.

4. Account and access

Using the App requires an account identified by an email address. By registering, you confirm that the information you provide is accurate and that the email address is yours.

Your responsibilities:

  • keep access to your email and device secure;
  • do not share account access with third parties;
  • tell us immediately about any unauthorised access to your account.

Any action taken in your account is treated as taken by you unless proven otherwise. We are not liable for the consequences of unauthorised access that occurs through no fault of ours.

One User uses one account. Creating multiple accounts to claim promotional terms repeatedly or to work around restrictions is not allowed.

You may delete your account at any time — from within the App or by contacting support. The consequences of deletion are described in the Privacy Policy.

5. Subscription, payment and refunds

The App’s basic features are free. Extended features are provided under a paid subscription.

Subscription terms:

  • The plan name, the features it includes, the price and the billing period are shown on the checkout screen immediately before payment. The terms shown to you at that moment are the ones that apply
  • By subscribing you accept the price displayed and agree to automatic renewal
  • The subscription renews automatically: at the end of a paid period we charge the same payment method for the next period without asking you again
  • If a charge fails — for example due to insufficient funds or an expired card — the subscription does not renew and access to paid features ends when the paid period does
  • We may change the subscription price. We will notify you at least 14 days before the next charge date. If the new price does not suit you, you may cancel before that date

Payment:

  • In the iOS app, subscriptions are bought as an App Store in-app purchase. The payment is handled by Apple, and Apple’s rules apply: managing, cancelling and refunding such a subscription is done through your Apple ID account settings and Apple Support. Card details stay with Apple and never reach us
  • Where a subscription is bought outside the App Store, the payment is processed by our acquiring bank. Card details are entered on the bank’s secure page and are not passed to us
  • We do not store card data. Automatic renewal of a subscription bought outside the App Store uses a technical token issued by the bank, which cannot be used to obtain your card details

Cancellation:

  • A subscription bought through the App Store is cancelled in your Apple ID settings; we cannot cancel it for you
  • Any other subscription you may cancel at any time — in the App or by contacting support
  • After cancellation, access to paid features remains until the end of the period you have already paid for, and no further charges are made
  • Cancelling a subscription does not delete your account or your data

Right of withdrawal and refunds:

  • Under EU consumer law you have 14 days to withdraw from a distance contract. For digital services the right of withdrawal is lost once performance has begun with your prior express consent and your acknowledgement that you thereby lose that right — which is what you confirm at checkout when access is granted immediately
  • Independently of the above, you may cancel before the paid period ends. In that case we refund the part of the amount corresponding to the unused remainder of the period, less costs we have actually incurred
  • If a charge was made in error — a duplicate charge for the same period, or a charge after cancellation — we refund it in full
  • Refunds for App Store purchases are issued by Apple, not by us: request them through Apple Support. We can help you with the request, but we cannot return money Apple has collected
  • For any other payment, write to support@himentor.org with the email address of your account and the date of the payment. We review requests within 10 calendar days
  • Refunds are issued to the payment method that was charged. The time it takes to appear depends on your bank and is usually between 3 and 30 calendar days
  • This section does not limit any mandatory statutory rights you have as a consumer

6. Acceptable use

When using the App you agree not to:

  • break the law or infringe the rights of others;
  • attempt to gain unauthorised access to the App, our servers, or other users’ accounts;
  • interfere with the service, create excessive load, or use automated tools to send requests at scale;
  • decompile, disassemble or otherwise try to derive the App’s source code, except where the law expressly permits it;
  • copy, distribute or resell the App’s functionality, or provide access to it to third parties for a fee;
  • use the App to diagnose conditions, prescribe treatment, or provide medical services to others;
  • enter knowingly false data in order to mislead other users or distort how the service works;
  • attempt to circumvent technical restrictions, including those of the paid subscription.

Breaching this section may lead to suspension or termination of access under section 12.

7. Data storage and processing

Data kept on your device only:

The following never leaves your device and is not sent to HiMentor servers or to third parties:

  • height, weight and their history;
  • physical activity level;
  • Apple Health / HealthKit data;
  • the list of supplements you take and your reminder settings.

Data sent to HiMentor servers:

Our servers hold your email address, your food diary entries (information about products and dishes), your AI assistant conversation history, and technical subscription details. This data is not shared with third parties and is not used for analytics or advertising.

Meal photos:

When you photograph a meal for recognition, the image is uploaded to our server and passed to the recognition model, which returns the dish and its estimated nutrients. The photo is kept only as long as processing requires and no longer than 30 days. Meal photos are not used for advertising and are not used to train models. Please avoid capturing faces, documents or other people's data in the frame.

Data sent to the language model (LLM):

When a language model is used to analyse nutrition, biometric data is de-identified: ranges are used instead of exact values (for example an age group or a weight band). The transfer happens from your device over a secure channel. Requests are logged through Langfuse solely for debugging and improving the quality of the App. Access to those logs is restricted by internal policy and is not used commercially.

Apple Health / HealthKit data:

Apple Health data is used solely to build recommendations on your device. It is de-identified in any transfer and is never used for advertising or analytics — in line with Apple’s requirements and HiMentor’s internal policy.

The full description of the data, purposes, legal bases and retention periods is in the Privacy Policy, which forms an integral part of these Terms.

8. User content and rights in the App

All rights in the App, the Site, their source code, design, texts, graphics, trade marks and other elements belong to the Company. No part of the App may be reproduced or used without the rights holder’s written permission.

You are granted a limited, revocable, non-exclusive and non-transferable licence to use the App on devices you own or control, strictly for personal, non-commercial purposes and in accordance with these Terms. No other rights are granted.

Rights in your User Content remain yours. You grant us a limited right to process that content only as far as running the App requires: to store it, display it to you, send it to the language model to generate an answer, and keep backups. We do not use your content to train models and we do not publish it.

You are responsible for the lawfulness of the content you enter into the App.

9. Availability

We aim to keep the App running without interruption, but we do not guarantee uninterrupted availability.

Service may be interrupted by maintenance and technical work, updates, hardware and network failures, and the actions of third parties — telecom operators, infrastructure providers, app stores and language model providers. Where planned work will materially affect availability, we try to give notice in advance.

Some features depend on an internet connection and on third-party services being available. Their unavailability is not a breach of these Terms on our part.

10. Limitation of liability

The App is provided “as is” and “as available”, without warranties of any kind. We work to keep calculations accurate: the accuracy of calorie and nutrient estimates reaches 95%, though in individual cases it can fall to around 80% depending on the product and the limits of the underlying data.

The information and recommendations the App produces are informational and educational only. They are not medical advice, a diagnosis or a prescription. We are not liable for any direct or indirect consequences of acting on data from the App. You use HiMentor at your own risk, understanding that final decisions should rest on the advice of qualified medical professionals.

In particular, we are not liable for:

  • decisions you or anyone else takes on the basis of information from the App;
  • inaccuracies caused by incomplete or incorrect data entered by the user;
  • loss of data stored on the device following deletion of the App, a device reset or failure, or the absence of a backup;
  • the operation of third-party services, including app stores, payment services, language model providers and partner marketplaces;
  • inability to use the App due to lack of internet access, an outdated operating system version, or restrictions on the device.

To the fullest extent permitted by applicable law, our aggregate liability under these Terms is limited to the amount you actually paid for the subscription during the 12 months preceding the event giving rise to the claim. This limit does not apply where liability cannot be limited by law, including liability to consumers for death or personal injury and liability for intentional misconduct.

11. Medical disclaimer

HiMentor is not a medical device and does not replace consulting a doctor or another healthcare professional. Its recommendations are based on averaged algorithms and do not account for your individual medical circumstances.

Any change to your diet, and any new supplement or biologically active substance, should be discussed with a doctor. Only a doctor can make a diagnosis or prescribe a treatment plan or a diet, after the necessary examinations.

The App is not intended for use with conditions that require medically supervised nutrition — including pregnancy and breastfeeding, eating disorders, diabetes, kidney and liver disease, allergies and intolerances. If any of these apply to you, use the App only in agreement with your doctor.

The App is not an emergency tool. If you have symptoms requiring urgent care, contact emergency medical services.

Please note that language models can “hallucinate” — produce invented or factually incorrect content. Treat the AI assistant’s answers critically and check them against your own situation. If you find a significant error, please report it to support; we use such reports to improve our algorithms.

12. Suspension and termination

We may suspend or terminate access to the App, in whole or in part, if:

  • you breach these Terms, in particular section 6;
  • your actions threaten the security of the service or of other users;
  • applicable law or an order from a competent authority requires it.

Except where immediate action is required, we will notify you of the breach first and give you a reasonable period to remedy it. Where access is terminated through your fault, the paid part of the subscription is not refunded, except where the law requires otherwise.

You may terminate these Terms at any time by deleting your account and the App.

We may discontinue the App altogether, giving users at least 30 days’ notice. In that case the unused part of a paid subscription is refunded pro rata.

13. Advertising and partner offers

HiMentor may show recommendations for partner products — supplements and food — when it detects nutrient imbalances in a user’s diet. All such offers are based solely on food diary data and are meant to inform users about products that HiMentor has vetted for quality.

Partner offers are clearly marked as advertising. They are links to marketplaces carrying vetted products and are not medical recommendations or prescriptions.

We are not the seller of goods listed on third-party platforms and are not responsible for their quality, completeness, delivery times or return conditions. A purchase creates a relationship between you and the seller on that platform, governed by that platform’s rules.

Apple Health data, biometric data and activity data are never used for advertising. Offers are generated solely from food diary information.

You are free to ignore any offer. Its presence does not affect the App’s functionality or your access to its core features.

14. Age restrictions

The App is intended for users aged 16 and over, in line with App Store requirements and applicable law. By using the App you confirm that you meet this requirement.

If we learn that an account was created by someone under 16, we may terminate access to it and delete the associated data.

15. Changes to these Terms

We may change these Terms, and we may change the App’s functionality by adding or removing features.

The current version is always available on the Site, with its version date at the top. For material changes — in particular to the subscription price, the payment procedure, the scope of liability or the set of paid features — we give at least 14 days’ notice before the change takes effect, through an App update, by email, or by other available means.

Continuing to use the App after a change takes effect means you accept the updated Terms. If you do not accept them, you may stop using the App and cancel your subscription before the effective date.

16. Force majeure

Neither party is liable for failing to perform its obligations where the failure is caused by circumstances beyond its reasonable control: natural disasters, acts of war, acts of public authorities, large-scale failures of communication networks and power supply, and blocking or restriction of access to third-party services the App depends on.

17. Governing law and disputes

These Terms are governed by the laws of the Republic of Cyprus, without prejudice to any mandatory provisions of the law of your country of residence.

We would rather resolve disagreements amicably. Before going to court, please send us a complaint at support@himentor.org; we will review it within 30 calendar days.

If a dispute cannot be settled, it is subject to the courts of the Republic of Cyprus. For consumers this does not remove the right to bring proceedings in the courts of their country of residence, or any other right granted by mandatory consumer protection law. Consumers in the EU may also use the European Commission’s online dispute resolution platform.

18. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions stay in full force, and the invalid provision is replaced by the closest lawful equivalent in meaning.

Our failure to exercise a right under these Terms is not a waiver of that right in the future.

You may not transfer your rights and obligations under these Terms to a third party. We may transfer our rights and obligations to a successor in the event of reorganisation or a transfer of rights in the App, having notified you.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding use of the App and supersede all prior arrangements on the subject.

These Terms are published in English and in Russian. In the event of a discrepancy, the English version prevails.

19. Terms required for the App Store version

The following applies to the version of the App downloaded from the App Store, and is required by Apple. Where it conflicts with the rest of these Terms, this section prevails for that version.

  • These Terms are concluded between you and HiMentor Ltd only, not with Apple. Apple is not a party to them and is not responsible for the App or its content
  • The licence granted in section 8 is limited to use of the App on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service
  • HiMentor Ltd, not Apple, is solely responsible for maintenance and support of the App. Apple has no obligation to provide any maintenance or support
  • In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App
  • HiMentor Ltd, not Apple, is responsible for addressing any claim relating to the App, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation
  • HiMentor Ltd, not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party claim that the App infringes that party's intellectual property rights
  • By using the App you represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties
  • You must comply with any applicable third-party terms of agreement when using the App
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you as a third-party beneficiary

We reply within one business day, excluding weekends and public holidays. In rare cases this may extend to 7 business days. Refund requests are handled within the period given in section 5; complaints within the period given in section 17.
